租赁屋顶安装光伏:农村光伏租赁屋顶要注意什么?

1、产权归属问题:根据《城乡规划法》规定:未取得建设工程规划许可证或者未按照建设工程规划许可证的规定进行建设的建筑、房屋、构筑物,属于违章建筑,县级以上城乡规划部门,有权要求限期拆除,没收实物或违法收入,并处罚款。在进行租赁前期,为避免后续的一些麻烦和可能造成的损失,首先应当对房屋的情况进行调查。房屋建设是否合规,是否具有建设规划许可证、竣工验收证明、消防验收证明和房屋产权证明,是否存在抵押、查封等情况。如若情况不明,在租赁时应当谨慎,尽量规避风险和后期不必要的纠纷。

2、屋顶使用问题:在租用前,承租方应该对房屋屋顶结构以及防水等问题进行勘察评估,并签订书面租赁合同,约定租赁期限、租赁用途、租赁价格和损坏修缮等条款,并向房产管理部门备案,以避免在光伏电站建设和运行过程当中产生不必要的麻烦和纠纷。

2. 3、合同能源管理问题:合同能源管理机制,简称EMC,是一种以节省的能源费用来支付节能项目全部成本的节能投资方式。简单点说,就是在光伏电站所发电量的分配和消纳问题,如何分配使得能源利用效率大化。出租方的用电量和附近是否有用电大户,直接关系到光伏电站所发电量的消纳以及电量利用效率的大化,同时还需要关注购电方的信用状况。

3. Simply put, it refers to the allocation and consumption of electricity generated by photovoltaic power stations, and how to allocate it to maximize energy utilization efficiency. The electricity consumption of the lessor and whether there are large electricity users nearby are directly related to the consumption of electricity generated by the photovoltaic power station and the maximization of electricity utilization efficiency. At the same time, it is also necessary to pay attention to the credit status of the purchasing party.

另外光伏电站发电所产生的碳排放指标如何分配和利用也关乎着电站的整体收益,所以,如何管理和利用能源,使得利用率大化,也是在屋顶租赁时需要考虑的问题。

4、政府征收拆迁补偿问题:根据《国有土地上房屋征收与补偿条例》规定,政府征收拆迁停产停业补偿对象是被征收人,也就是房屋产权所有人,租用方不能直接向政府索要赔偿。光伏电站依附于房屋建筑,国家对房屋进行征收和拆迁,因此停产停业损失补偿应该包括光伏电站停产的损失补偿,但光伏电站应该证明其自身存在经营行为,具有营业执照和相关手续,以证明该项目和经营的合法性,同时还需要证明光伏电站的价值,以及现有和未来的收益情况。再有需要解决的就是补偿到位后,出租方和承租方如何进行分配的问题。

4.
